1. Introduction
Welcome to ManageMyTrust ("Service", "Platform", "we", "us", or "our"), accessible at managemytrust.in.
The Service is owned and operated by Sudeep Ivan DSouza, an individual resident in India, operating as a sole proprietorship under the trade name "ManageMyTrust" (the "Owner"). ManageMyTrust is a web-based management software designed to help administrators of charitable trusts, non-governmental organizations (NGOs), and similar entities manage donor information, beneficiary details, projects, and related operational data.
By accessing or using ManageMyTrust, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.
1.1 Definitions
"Customer Data" means all data, information, or content submitted to the Service by or on behalf of you or your organization, including donor, beneficiary, and project information. "Service" means the ManageMyTrust web-based software platform and all related features and services. "Owner" means Sudeep Ivan DSouza, sole proprietor operating under the trade name "ManageMyTrust".
2. Eligibility and Authority
You represent and warrant that:
- You are authorized to act on behalf of the organization you represent.
- You have the legal capacity to enter into these Terms.
- Your use of the Service complies with all applicable laws and regulations, including those relating to charitable activities, taxation, foreign contribution regulations (where applicable), and data protection laws.
3. Use of the Service
3.1 Permitted Use
You may use the Service solely for lawful purposes related to charitable or non-profit administration, including:
- Managing donor and donation-related information
- Managing project and beneficiary information
- Internal reporting, compliance, and record-keeping
3.2 Prohibited Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or misleading purpose.
- Upload or process data that you do not have the legal right or consent to use.
- Attempt to gain unauthorized access to the Service, servers, or networks.
- Interfere with or disrupt the integrity, performance, or security of the Service.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Use automated systems or excessive requests that may impair the Service.
3.3 No Professional or Compliance Advice
The Service is a management and record-keeping tool only. We do not provide legal, tax, financial, or regulatory advice and assume no responsibility for your organization's compliance obligations.
4. User Accounts and Security
- Access to the Service may require user accounts created or invited by an authorized administrator.
- You are responsible for maintaining the confidentiality of your login credentials.
- Administrators are responsible for assigning appropriate roles and permissions.
- You must notify us promptly of any unauthorized access or security breach.
- We are not responsible for losses arising from unauthorized use of your account due to failure to safeguard credentials.
5. Data and Content
5.1 Ownership of Data
All Customer Data remains the property of your organization.
5.2 Responsibility for Data
- The accuracy, quality, and legality of Customer Data.
- Obtaining necessary consents from donors, beneficiaries, and others.
- Compliance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
5.3 Data Processing
ManageMyTrust acts as a data processor and processes Customer Data only in accordance with your instructions, applicable law, and these Terms.
5.4 Lawful Disclosure
We may access, preserve, or disclose Customer Data if required by law, court order, or a valid governmental request.
6. Privacy
Your use of the Service is subject to our Privacy Policy, which forms an integral part of these Terms. In case of conflict, the Privacy Policy shall prevail with respect to personal data.
7. Availability and Changes
- We do not guarantee uninterrupted or error-free operation.
- No service level agreement (SLA) applies unless agreed in writing.
- We may modify or discontinue the Service at any time.
- Continued use after updates constitutes acceptance of revised Terms.
8. Intellectual Property
All intellectual property related to ManageMyTrust is owned by or licensed to the Owner. These Terms grant only a limited right to use the Service.
9. Third-Party Services
The Service may integrate with third-party services. We are not responsible for their content, availability, or practices.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law.
11. Limitation of Liability
11.1 No Indirect Damages
The Owner shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of donations, data, or goodwill.
11.2 Liability Cap
Total liability shall not exceed the amount paid in the preceding twelve (12) months or INR 1,000 if the Service was provided free of charge.
12. Indemnification
You agree to indemnify and hold harmless the Owner against claims arising from your use of the Service or violation of these Terms.
13. Termination and Service Continuity
13.1 Termination
We may suspend or terminate access for violation or misuse. You may stop using the Service at any time.
13.3 Data Export
You will have at least fifteen (15) days to export Customer Data unless terminated for illegal activity.
13.4 Survival
Key provisions survive termination, including liability, IP, and governing law.
14. Fees and Payment
Subscription fees are non-refundable and exclusive of applicable taxes, including GST.
15. Force Majeure
We are not liable for delays caused by events beyond reasonable control.
16. Governing Law and Jurisdiction
These Terms are governed by Indian law. Courts in Bengaluru, Karnataka have exclusive jurisdiction.
